Terms and Conditions
OBJECTIVE.
Deliver to clients, the policies, conditions, terms and others of the room or apartment reservation at Simmer Down Guest House, located on San Andrés Island, to comply with the internal guidelines, hotels and applicable legal provisions, including acceptance of these terms and conditions, such as the characteristics of the reservation, rates, entry, instance and exit, cancellation, services, policies, such as recognizing that you have full legal capacity to subscribe to these terms and conditions, likewise that you guarantee to deliver the veracity of the data and information provided as well as the other provisions herein contemplated; Therefore, the client accepts these terms and conditions, also accepts that no reservation is valid without said acceptance.
SCOPE.
Applies to all clients of legal age and with legal capacity, to acquire the individual reservation, by any means used and accepted by Simmer Down Guest House, for accommodation in rooms or apartments.
RESERVATION POLICIES.
- Payment policy:
To make a reservation, a deposit of 50% of the total amount of the reservation must be paid, so that the dates are blocked and the reservation is confirmed. With 14 days to go before the start of the reservation, the client will receive an email requesting the remaining 50% of the reservation, which must be paid within the next 24 hours of receiving the email, otherwise the reservation may be canceled and the Dates may be enabled, with which the client could lose their reservation if they do not cancel on time. If there are problems making the payment, the client must contact the administration of Simmer Down Guest House to find a way to temporarily resolve until payment is received.
- Check-In and Check-Out Policy:
The reservation begins at 3:00 p.m. on the day it is agreed and ends at 12:00 p.m. (12 noon) on the day or date the reservation ends, clarifying that it is Colombia time; exceeded one (1) hour after the Check-Out time, generates additional costs for the guest.
- Cancellation and Modification Policy:
The guest may cancel his reservation up to 30 days before the beginning of the reservation without any penalty and may modify his reservation 14 days in advance, if it is within the period of 14 days before the reservation, the client may make modifications without penalty, but if the reservation is cancelled, the deposit will not be refunded. Reservation modifications will not incur any penalties, except during peak season, and are subject to availability.
If the guest decides to cancel the reservation within 14 days of the reservation, Simmer Down Guest House will retain the full amount paid by the person making the reservation.
- Underage Registration Policy:
If the client presents himself to Simmer Down Guest House with minors under 18 years of age assisting him with the obligation to inform him, he must present the identification document of the minors, which demonstrates the existence of the relationship. If minors do not travel in the company of their parents, the client must deliver, in addition to the minor’s identification document, the parent’s permission, which must be authenticated by a Notary and accompanied by a copy of the identification document of who gave the authorization. Without this documentation, minors are not allowed to enter the hotel or make reservations at the hotel. The foregoing in accordance with the provisions of Law 679 of 2001, Statute to Prevent Sexual Exploitation of Children and Adolescents and its concordant norms.
- Foreign Reservation Policy:
All foreign clients who request a reservation or appear at Simmer Down Guest House without exception, including foreign minors, must present their corresponding personal and family documentation, that is, the passport or the required documents, in accordance with the regulations of the Colombian State for foreigners for their stay.
- Early Check In Policy:
Simmer Down Guest House does not undertake to register prior to Check-In, except for the following conditions. A.- That there is availability without altering the good service. B. If the Early In is done after After 9:00 a.m. on the day of the reservation, admission to the room is granted as a courtesy service by Simmer Down Guest House. The client accepts that, if Simmer Down Guest House performs the Early In, at times such as those listed below, will have additional fee, as follows: A.- If the check-in is made before 6:00 a.m. on the day of the reservation, the total amount of the previous night will be charged. B.- If check-in is between 6:00 am and 9:00 am on the day of the reservation, half the rate per night purchased for your stay will be charged.
- Late Check-Out Policy
The customer agrees and accepts the following: A. Subject to availability. B.- Late Check-Out is accepted until 3:00 p.m. (3:00 p.m.) without charge. C. Late Check-Out, between 3:00 pm (15:00) and 6:00 pm (18:00) without exception, will be charged half of the purchased rate for the value of one night of the guest’s stay. D. Late Check-Out, which occurs after 6:00 pm (18:00) without exception, will be charged the full rate purchased for the guest’s stay for the value of the last night of accommodation.
- Additional Reservation Policies:
Simmer Down Guest House accepts no responsibility for the following: A.- For not being able to comply or partially comply, in service, time and others of the reservation due to cases of: Force majeure, fortuitous event, unpredictable or insurmountable actions of third parties and clients, the non-availability of the Internet network, the inability to access the website, computer virus intrusion such as unauthorized prepayment by the cardholder’s bank. B.- Likewise, for any reservation or payment that is irregular, ineffective, incomplete or fraudulent for any reason attributable to the client, it will mean the cancellation of the order or reservation at the client’s expense, without prejudice to the necessary legal actions against the client or guest. C. When making the reservation, the guest or client is fully and exclusively responsible for the accuracy of all the data provided or recorded, in case of inconsistency or alterations, it entails or causes the cancellation of the reservation.
SPECIAL LEGAL CONDITIONS POLICY.
- Anti-corruption and anti-fraud policy:
Simmer Down Guest House does not permit, accept, or engage in dishonest behavior or practices that undermine business or personal integrity. These include: accepting or offering gifts, invitations, or other incentives that may reward or influence the taking or refraining from taking any commercial or legal action; nor concealing, altering, falsifying, or omitting information for one’s own benefit or that of others; or engaging in potential conflicts of interest that could put personal priorities before collective ones; promoting a culture of ethics, transparency, and integrity in the conduct of its activities.
- Policy for the Prevention of Money Laundering and Financing of Terrorism:
Simmer Down Guest House has clarity, responsibility and awareness of the fight against Money Laundering and Terrorism Financing – ML/FT, therefore it promotes, complies and places all efforts, means, support, information and others necessary to prevent and avoid being involved in illegal acts, not only for reasons of loyalty, commercial principles, but also for fundamental reasons of responsibility, ethics, respect for the law and supports state agencies to be in accordance with compliance with state or international policies, as well as regulations on the matter.
Due to the foregoing, Simmer Down Guest House requests as a necessary obligation that the client or guest declare under oath, which is understood to be provided with the acceptance of the reservation, that the resources that make up their assets do not come from money laundering, financing of the terrorism, drug trafficking, kidnapping, illegal collection of money and in general any illegal activity contemplated in Colombian legislation or international treaties; In the same way, it manifests that the resources delivered or that it will deliver as consideration for the services offered by Simmer Down Guest House, come from an exclusive activity that is lawful or legally permitted; Therefore, the client authorizes the Simmer Down Guest House, in the event of any anomaly or seriousness in the reservation, money, people or guests, to inform the competent authorities for the relevant purposes; Likewise, it is the guest’s obligation to provide real and true all the information provided for the reservation, including the name of the guest, activity and origin of the money, in addition, that the occupation, companies, procedures, acts and finances of all the guests are of legal activity; statement that is understood to be provided when accepting the terms and conditions of the reservation.
ENVIRONMENTAL, FLORA AND FAUNA POLICIES.
- Sustainability Policy:
Simmer Down Guest House is committed to the sustainable development of our environment, assuming the legal commitment in environmental, sociocultural and economic aspects, through the care and improvement of the same, including the physical and moral integrity of clients or guests, applying measures security and surveillance aimed at preserving all rights; Therefore, we comply with and request prevention, control and improvement measures to minimize the impact on our environment, inviting our guests, clients, suppliers, employees and collaborators to comply with said aspects.
- Flora and Fauna Policy:
Simmer Down Guest House protects the flora and fauna of our country, for this reason it controls, nor allows the purchase, trafficking or captivity of endangered animals, nor products made with plants or said animal species; Likewise, it does not invite to carry out practices that threaten the flora and fauna in compliance with Law 1333 of 2009.
- Policy Anti-smoking Law
In accordance with Law 1335 of 2009 Simmer Down Guest House has smoke-free spaces and environments. Consequently, the guest accepts as an obligation to refrain from smoking in private, social and closed spaces, areas and environments, such as rooms, corridors, bathrooms, lounges and others; If the guest fails to comply with this obligation, he agrees to pay a penalty of $200,000 Colombian pesos or its equivalent in US dollars.
DATA OR PERSONAL INFORMATION POLICIES.
- Personal Data Processing Authorization:
The client or guest authorizes Simmer Down Guest Houses to process their personal data, delivered or supplied through various marketing channels such as websites, call centers, among others. Simmer Down Guest House informs that personal data will be kept with special care, in accordance with the provisions of Law 1266 of 2008, Law 1581 of 2012, Decree 1377 of 2013 and other regulations related to the matter.
During the booking creation process a user account will be created automatically with the user’s data.
ADDITIONAL RESERVATION POLICIES.
- Information received by the client or guest and acceptance of these:
The client confirms that he has received from the Simmer Down Guest House all the necessary or complementary information for the reservation, the terms, values, valid, conditions, changes, duration of the same and others, including everything related to the facilities, services, location, including through the website, mobile services and other means of communication; Therefore, any reservation made through the website, mobile services and any other means, implies that I make the inquiry and fully and without limitation accept these terms and conditions of any type of reservation. Due to the above, the reservation is considered fully accepted by the client or guest, regardless of the means of communication or electronic by which it was made, approving and assuming the terms and conditions of this. The reservation is strictly personal and cannot in any case be transferred under any condition or circumstance to third parties, neither for free, nor by endorsement or assignment, nor by prior payment or for commercial purposes between the client or guest and said third party.
- Registration, Rates, Guarantees And Commitments Of Stay Or Lodging At Simmer Down Guest House:
The client or guest accepts and agrees to the following: A.- Provide a contact telephone number and email address, and any other necessary requirements in accordance with Colombian law, if necessary. B.- Based on the prices or rates agreed upon in the reservation, this includes and indicates the type of room or apartment, number of people, dates and times of check-in and check-out, and other conditions. C.- The rate or price agreed upon in the reservation entails the liquidation and addition of all taxes determined for the accommodation service by the Colombian State, existing at the time of payment. D.- When making the reservation, the client or guest will do so using the payment methods accepted by the website. E.- The value of the reservation does not include services not stipulated in the same, for greater clarity the reservation is limited to lodging. F.- Clients or guests accept and agree to use their room in a respectful and responsible manner; therefore, any conduct contrary to the rules of good coexistence, behavior, public order and others, leads to the Simmer Down Guest House, requesting the client or guest who directly or indirectly has failed to comply with said regulations, to abandon the Simmer Down Guest Houses premises without compensation or refund in the event that payment has already been made; if no payment has been made, the client or guest must pay the price of the nights of stay already enjoyed before leaving Simmer Down Guest House, without the previous breach being able to lead to other legal actions. G.- Simmer Down Guest House offers Wi-Fi access free of charge, but due to its location, normal service is not guaranteed. Likewise, clients and guests will not use it in any way to reproduce, perform, or publicly communicate works or projects protected by law without the authorization of the owner of said rights. Clients are also required to comply with the security policy of Simmer Down Guest House’s Internet service provider and the rules for using security resources, the purpose of which is to prevent the illicit use of computing resources and avoid any abusive, irresponsible, or illegal acts. H. The client or guest, at the time of making the reservation, agrees to incur the transaction costs derived from the chosen payment gateway, in the case of choosing payment through the ePayco gateway, the fee will be 4% of the value paid, plus 900 Colombian pesos per transaction, and in the case of payment through bitcoin, the guest or client will be the one who contributes the transaction cost taking into account including a sufficient commission so that the transaction is included in the first or second block of the blockchain after the reservation is made.
IMPECCABLE STANDARDS AND ACCEPTANCE OF TERMS AND CONDITIONS.
The contractual relationship generated by the concept of reservations or derived from it, in the event of any dispute between Simmer Down Guest House and the client or guest, will be governed by the regulations in force in the Colombian State on the matter and will be resolved by Court of Arbitration of the Chamber of Commerce of San Andrés Island, if this instance were unsuccessful, it will go before the competent ordinary civil jurisdiction. With the payment and confirmation of your reservation, you as a client or guest fully accept the terms and conditions related here, accepting that you have read and fully understood them, therefore, by accepting the reservation, you give full validity and legality of what is stipulated here.
